COLLECTION OF INFORMATION

Personal Information is defined as your name or information that would enable you to be contacted, as well as your profession, any financial or medical information.

The Website is designed to allow TMC members to voluntarily share their personal information with each other. If you provide Personal Information to the Website, it will be collected and stored by TMC in order for you to use the Website. If you are concerned about providing your information to TMC for this purpose, please do not use the Website.

TMC collects a variety of Personal Information about you through your use of the Website, primarily through information you voluntary submit. You may submit information by clicking on various links, such as "Contact Us." Additionally, TMC collects such information when you apply for membership, register for the Website, login and use the website, request information, complete the area of your public account, or by using the Website.

Non-Personal Information
TMC may collect non-Personal Information about you or your activity at the Website. Non-Personal Information may be collected at various stages in the Website, including when you post non-Personal Information to your profile. The Website may automatically recognize and store information about the type of browser you are using; your Internet Protocol ("IP") address; the time, date, and length of your visit; the pages you visit, and the referring site. CONSENT TO PROCESS INFORMATION

By using the Website and submitting information to it, you hereby consent to allow TMC to process information in accordance with this Policy. You understand that Personal and non-Personal Information you submit to the Website or that is collected when you visit the Website may reveal your identity or aspects about it and about you. Please note that if you delete your account, TMC may retain your Personal Information and non-Personal Information in a non-public format to process aggregate data, or in a non-aggregate format for business purposes, as TMC, in its sole discretion, deems appropriate, in accordance with applicable law. Although TMC may retain your information that it collects, it is under no obligation to do so, and may delete its records of your information, Content, Submissions, Material or other matter at any time, without your consent and in TMC's sole discretion.

To the extent you purchase goods or services on the Website, from TMC or through which TMC processes credit card information, you agree that TMC may retain such information for archival purposes for a reasonable time. You agree that TMC shall not be liable for any non-intentional data breaches and agree to hold TMC harmless therefrom.

ACCESS, UPDATE AND OPT-OUT

If you would like to access or update any information you have sent to TMC, if you do not want to receive information from TMC, please do so through the tools available in your account or contact us at webmaster@eatingvine.com. At such a time, TMC may request that you verify your identity so that TMC may ensure the accuracy and lawfulness of granting you such access.

TMC will make reasonable efforts to honor requests you make to access and update your information or to forgo contacts with you in the future, except to the extent that the burden of complying would be disproportionate to the risks to your privacy in the case in question, or as otherwise permitted by law. If you make an opt-out or modification request, TMC may retain your contact information or your original information. Additionally, if you request TMC to refrain from sharing your information with third parties, TMC may be unable to fulfill various requests you may make.

To the extent required by the CAN-SPAM Act, or other similar domestic and international regulation, commercial e-mail messages will provide you with an opportunity to opt-out of receiving such information. Please note that changes to your preferences may not be effective immediately.

CALIFORNIA PRIVACY RIGHTS

Beginning on January 1, 2005, California Civil Code Section 1798.83, also known as S.B. 27, or the "Shine the Light" law, allows California residents to request certain information regarding our disclosures in the prior calendar year, if any, of their personally identifiable information to third parties. You must include sufficient detail for us to locate your information; at a minimum, your name, email and postal address.

We will attempt to provide you with the requested information within thirty (30) days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note that the California Shine the Light law does not cover all information sharing. Our disclosure only includes information covered by the law.
